Agreement and operator
These Terms are between the Shopify merchant accepting them ("Merchant" or "you") and the individual software developer based in the People's Republic of China who operates AttribGate under the public service name SkyMork ("SkyMork", "we", "us", or "our"). SkyMork is not presented as an incorporated company. Legal operator details are available on a valid contractual, regulatory, or legal request. By installing, accessing, or using AttribGate on behalf of a merchant, you confirm that you are authorized to bind that merchant and agree to these Terms, our Privacy Policy, and our Data Processing Agreement.
Business eligibility
AttribGate is offered for business use by Shopify merchants and their authorized staff, not for personal or household consumer use. You must be legally able to enter a contract and have authority to connect the relevant Shopify, Awin, and Impact accounts.
Service scope
AttribGate compares Shopify order evidence with claims from merchant-connected affiliate networks and presents recommendations for pre-payout review. It is not affiliate recruitment, affiliate program management, storefront tracking, accounting, tax, or legal advice. Shopify remains authoritative for order facts, and each affiliate network remains authoritative for its own claims and final status.
Beta service
The current service is an invite-only beta. Initial review is limited to the most recent 60 days available through Shopify's standard order scope. Awin is the current seed-provider path; Impact support is in beta until its provider acceptance is complete. Features may change, be limited, or be withdrawn. No service-level, uptime, response-time, savings, attribution-accuracy, or continued-availability commitment applies unless we agree to one in a signed order form.
Merchant decisions and network actions
Recommendations are evidence for human review, not automatic verdicts. Network writeback is disabled when an account is connected or credentials are replaced. If a merchant later enables writeback, each eligible approve or decline action still requires separate confirmation. You remain responsible for payout decisions, affiliate contracts, tax treatment, network permissions, and verifying the final provider result.
Accounts and credentials
You must provide accurate account information, protect your Shopify and network access, grant only permissions needed for the service, and notify us promptly of suspected compromise. You authorize us to access connected services only as needed to provide AttribGate. You must not send API tokens, buyer data, or order exports by email.
Acceptable use
You must not use AttribGate unlawfully; access another merchant's data; bypass authentication, tenant controls, rate limits, or network permissions; probe or disrupt the service; upload malicious code; reverse engineer except where law expressly permits; or use recommendations to misrepresent attribution or withhold amounts in breach of an affiliate agreement.
Third-party services
Shopify, Awin, Impact, Cloudflare, and Aiven are third-party services with their own terms and availability. You are responsible for your contracts with Shopify and connected affiliate networks. We are not responsible for a third party's independent acts, outages, API changes, or decisions, but we will use commercially reasonable efforts to make AttribGate fail safely.
Data protection
Our Privacy Policy explains what we process. When we process personal data on your instructions, the DPA is incorporated into these Terms. You are responsible for the lawfulness of your instructions and for notices or consents required in your merchant-customer and affiliate relationships.
Fees
The invite-only seed beta is currently provided without an app charge. If paid plans are introduced, pricing will be disclosed before a charge and any Shopify app fee will use Shopify App Pricing or the Shopify Billing API. Continued use of a paid plan will require the merchant's approval through the applicable Shopify flow.
Ownership
SkyMork retains all rights in AttribGate, its software, documentation, and branding. You retain rights in your data. You grant us a limited right to process that data only to provide, secure, support, and comply with law for the service. Feedback may be used without restriction provided it does not identify you or disclose confidential information.
Suspension and termination
You may stop using the service and uninstall the app at any time. We may suspend or terminate access for material breach, security risk, unlawful use, non-payment of a future approved charge, or where a third-party dependency makes continued operation impracticable. Uninstall stops future scheduling and triggers Shopify's privacy lifecycle; authenticated shop-erasure processing deletes tenant-scoped active data as described in the Privacy Policy and DPA.
Disclaimers
To the maximum extent permitted by law, the beta service is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free or complete attribution. Nothing in these Terms excludes a warranty or liability that applicable law does not permit us to exclude.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential loss, or for lost profits, revenue, goodwill, or data. SkyMork's aggregate liability arising from the service will not exceed the greater of USD 100 or the fees you paid for AttribGate during the three months before the event giving rise to the claim. These limits do not apply to fraud, willful misconduct, breach of confidentiality or data-protection obligations, infringement or misappropriation of the other party's intellectual property, or liability that cannot legally be limited.
Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. Before filing a claim, each party will give written notice and attempt in good faith to resolve the dispute for 30 days. If it remains unresolved, the courts with jurisdiction at the operator's domicile in China will have exclusive jurisdiction, except where applicable law requires another forum.
Changes and general terms
We may update these Terms for service, legal, or security changes. Material changes will take effect after reasonable notice unless an urgent change is required by law or security. If you do not agree, your remedy is to stop using and uninstall AttribGate before the change takes effect. These Terms, the DPA, and any signed order form are the agreement for the service. If a provision is unenforceable, the remainder continues. Neither party waives a right by delaying enforcement. You may not assign the agreement without our consent; we may assign it to a successor operating the service with notice.
